Calling on the Minister of Municipal Affairs and Housing to amend the Ombudsman Act to require the Ombudsman to provide information about each investigation to the municipality referred to in each Annual Report, to allow the municipality to fully understand and address the subject matter of each case, including:
a copy of each complaint (with individuals' personal information redacted)
identities of the municipality's employees, officers and members of Council who were consulted as part of the investigation
particulars of the outcome of the investigation
While it is certainly important for a municipality to be able to understand and be allowed to correct situations being brought to the Ombudsman, the particulars of this request are concerning. It could, for instance, "out" whistleblowers, and discourage people from coming forward. Consider Barrie's recent "Workplace Harassment" case, for instance, and the fact that there is no way to remove a member of Council found to have harassed a staff member (and now, in Barrie and several other municipalities, the "Strong Mayor Powers" which allow a Mayor to fire staff, etc.) – if someone makes a complaint to the Ombudsman, or provides information as part of an investigation, there could be serious repercussions if their identities were required to be automatically sent to the municipality.
